Terms of Service

1. Acceptance of Terms

By accessing or using the OPMODE application ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

2. Description of Service

OPMODE is a tactical fitness training application that provides structured workout programs, ML-powered load recommendations, fitness assessments, recovery tracking, and gamification features designed for military, law enforcement, and first responder personnel, as well as general fitness enthusiasts.

3. Beta Program

OPMODE is currently in public beta. During the beta period:

• The Service may contain bugs, errors, or incomplete features
• Features may be added, modified, or removed without notice
• Data collected during beta may be reset if necessary (we will provide advance notice)
• Beta testers may receive free or discounted access to Pro features
• We appreciate and may solicit your feedback to improve the product

4. Accounts

You must create an account to use the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must provide accurate information and keep it up to date. You may delete your account at any time from Settings.

5. Subscriptions & Payments

5.1 Plans

OPMODE offers a free tier and a Pro subscription. Pro is available as a monthly plan ($19.99/month) or annual plan ($159.99/year). Prices are in USD and may vary by region.

5.2 Billing

Subscriptions are billed through Google Play Store or Apple App Store. Payment is charged to your store account at confirmation of purchase. Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period.

5.3 Refunds

Refund requests are handled by the respective app store according to their refund policies. For Google Play, you can request a refund within 48 hours of purchase through Google Play. For issues not resolved by the store, contact us directly.

5.4 Free Trial

We may offer free trial periods. If you do not cancel before the trial ends, your subscription will automatically begin and you will be charged.

6. Fitness Disclaimer

IMPORTANT: Please read this section carefully.

OPMODE provides fitness programming and recommendations for informational and educational purposes only. The Service is not a substitute for professional medical advice, diagnosis, or treatment. Always consult your physician or qualified healthcare provider before beginning any new exercise program, especially if you have a pre-existing medical condition, injury, or are taking medication.

• You exercise at your own risk. OPMODE is not responsible for any injuries sustained while following our programs.
• ML-powered load recommendations are estimates based on your training history and should be treated as suggestions, not prescriptions.
• If you experience pain, dizziness, or discomfort during exercise, stop immediately and seek medical attention.
• The operational readiness score and recovery metrics are tools to guide your training, not medical diagnostics.

7. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to gain unauthorized access to any part of the Service
• Reverse engineer, decompile, or disassemble the Service
• Distribute, share, or resell your account or subscription access
• Submit false or misleading bug reports or feedback
• Interfere with or disrupt the Service or its infrastructure

8. Intellectual Property

All content, features, and functionality of the Service (including workout programs, UI design, logos, and code) are owned by OPMODE and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, or distribute any part of the Service without our written permission.

9. Account Deletion

You may delete your account at any time through Settings > Account > Delete Account. Upon deletion:

• All your personal data, workout history, and settings will be permanently deleted
• Active subscriptions should be canceled through your app store before deleting your account
• This action is irreversible
• Local data on your device will be cleared immediately

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OPMODE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, PERSONAL INJURY, OR DAMAGES ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICE IN THE 12 MONTHS PRECEDING THE CLAIM.

11. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, with or without notice. Upon termination, your right to use the Service ceases immediately. Sections that by their nature should survive termination will survive (including liability, intellectual property, and dispute resolution).

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by updating the "Last updated" date. Continued use of the Service after changes constitutes acceptance. If you disagree with the new Terms, you should discontinue use and delete your account.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States. Any disputes arising from these Terms or the Service shall be resolved in the appropriate courts.
